Proposed Revision to 24 CFR 3282

Subject: Special Procedures for Limited Work to Complete Manufactured Homes on Site

Background: HUD announced in its October 29, 1997, Semiannual Regulatory Agenda in the Federal Register that, under its Reinventing Government effort, it is considering the establishing of special procedures to permit limited completion of manufactured homes on site under the current enforcement regulations at 24 CFR 3282.14, Alternative construction of manufactured homes. HUD stated: "This rule will propose a new process, under which manufacturers and State and private inspection agencies could agree to permit limited site work under certain conditions, to complete production of manufactured homes, without prior approval by the Secretary. This new process would supplement the current process for approving alternative construction methods."

The Manufactured Housing Institute herein sets forth a set of recommended procedures to implement the concept proposed by HUD in its October 29, 1997, Semiannual Regulatory Agenda.

Concept: The Secretary would amend 24 CFR 3282, to add the following new section as a companion to the current process for approving alternative construction methods:

"Special procedures for limited work to complete manufactured homes on site. A manufacturer may provide for the completion of the construction of a manufactured home on site without approval by the Secretary, when each of the following procedures is achieved:

(a) The manufacturer shall submit to the DAPIA such information as the DAPIA may require in order to carry out design approvals, in accordance with sections 3282.203 and .361. This information will include designs and supporting materials to demonstrate that the completed manufactured home shall comply with the Standards.

(b) The manufacturer shall submit to the DAPIA such information as the DAPIA may require under section 3282.361, in order for the DAPIA to review and approve the site-inspection procedure for those portions of construction that are to be completed on site in accordance with the Standards;

(c) The manufacturer shall provide to the IPIA-approved on-site inspection agency DAPIA approved plans for the completion of the construction of the manufactured home on the designated site; and:

(1) The home shall be completed on site in accordance with the DAPIA approved construction details; and,

(2) The IPIA-approved on-site inspection agency shall monitor at least 10 percent of the homes which are being built to the DAPIA approved design for work to be completed on site; for each individual home to be monitored under this section, at least 25 percent of the on-site construction shall be inspected including all safety related constructions; and,

(d) The manufacturer shall provide a notice to prospective purchasers which stipulates that the manufactured home will meet the provisions of the Standards after it is completed on site."
