The Federal Housing Finance Agency (FHFA) has announced that Fannie Mae and Freddie Mac will no longer enforce the CARES Act’s 30-day notice to vacate requirement. In August, HUD eliminated this requirement for public housing and HUD-assisted properties. This outdated COVID-era standard has created unnecessary and costly burdens for housing providers.

With FHFA’s action, Fannie Mae and Freddie Mac policies now provide private sector rental housing providers the same relief from what was intended to be a temporary measure. Since March 2020, MHI has worked closely with its national rental housing coalition partners to resolve this lingering pandemic-era issue. MHI commends FHFA for finally removing these outdated regulations for those housing providers financed by Fannie Mae and Freddie Mac.

Rental housing providers—whether in HUD-assisted properties or other communities—play a vital role in housing America. Policies that reduce administrative burdens and restore clarity are essential to ensuring these providers can continue offering safe, affordable homes. MHI will continue to support federal efforts to strengthen housing programs and encourage government collaboration with the private sector to expand access and affordability nationwide.
